Similar to how the laws of recreational or medical marijuana vary from state to state, there are also specific rules and regulations regarding the use of Hemp and CBD that differ from one state to another. Some of which are not federally regulated at all.
Today, eleven states have legalized the use and possession of recreational marijuana for adults, and over half of the United States has approved comprehensive, publicly available medical marijuana/cannabis programs.
Cannabidiol, commonly known as CBD is a natural compound that is found in the cannabis plant. CBD can be extracted from either Hemp or Marijuana, but because Hemp contains virtually no THC, it is used as a main source for Cannabidiol.
CBD is a non-psychoactive compound, which means that it will not produce a “high” on its own, making CBD products the perfect solution for those who may be suffering from medical conditions, or health issues such as, Depression, Pain, Anxiety, and more. Many people use CBD for pain and management, but it is always recommended to seek medical advice from your primary care doctor for further use and instruction.
One of the most liberating moments for CBD and Marijuana came in 2014 with the passing of the Farm Bill.
Section 7606 of the bill defines industrial hemp as Cannabis Sativa containing 0.3% of THC or less. This allows state agriculture departments to cultivate hemp for the purposes of agricultural or academic research. This also opens up the opportunity for farmers to get certified by their state agriculture department to grow hemp. Importantly, the bill extended the jurisdiction of hemp production from the DEA alone to also include the USDA and FDA—opening the door for future regulation.
In December of 2018, Congress passed The Hemp Farming Act in The Act was included in the 2018 Farm Bill, which is officially known as the Agriculture Improvement Act of 2018.
This bill removes hemp from the controlled substances list, and as a result, also removes it from the oversight of the DEA. Any industrial hemp product is now legal on a federal level nationwide, including CBD. However, the bill also gives individual states the ability to oversee hemp production and therefore restrict them if they see fit.
It is worth remembering that the laws in your state can also vary, depending on your intended use for the CBD and where it was sourced from. Below we have listed the laws regarding CBD in each of the fifty states. We recommend that you know your state’s CBD Laws and regulations before purchasing.
